It is the process where the surrogate mother is directly impregnated by the intended Father. In this case, the mother is the genetic mother of the baby.
2) Gestational Surrogacy
It is the process in which the embryo is conceived through IVF and then transferred into a surrogate mother. In this case, the mother delivering the baby is not genetically associated with the baby.
The general process in surrogacy is the intended parent/s search for a surrogate mother through a third party (usually an IVF center) and enter into the contract for surrogacy with the women. Required medical and psychological test is done on the women to assess if she is fit for the surrogacy process and delivering the healthy baby for intended parents. Surrogacy is legal in India and has been leading to a successful journey towards a complete family for several hundred couples.
The Surrogacy (Regulation) Bill-2016 India, has proposed to regulate surrogacy in India by setting up National Surrogacy Board and State Surrogacy Board at National and state level respectively.
The bill intends to make it legal by ensuring strict regulation of surrogacy, allowing altruistic surrogacy for needy couples and a blanket ban on commercial surrogacy. This process will keep a tab on the unethical practices by people who exploit this process for minting money.
